This End User License Agreement ("EULA" or "Agreement") is a legal contract between you ("you" or "End-User") and Trevlo Tech LLC ("Company," "we," or "us"), the developer of the Tsunami Watch mobile application (the "App" or "Licensed Application"). The App provides tsunami and related emergency alerts and information.
By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the App.
1. Acknowledgement
This EULA is concluded between you and Trevlo Tech LLC only, and not with Apple or Google. We, not Apple or Google, are solely responsible for the App and its content. This EULA does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions or the Google Play Terms of Service.
2. License Grant and Scope
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any compatible mobile device (Apple-branded products for iOS, or Android devices for Google Play) that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions or Google Play Terms of Service. The App may also be accessed and used by other accounts associated with you via Family Sharing (Apple) or family group features (Google), where permitted. You may use the App for your personal, non-commercial purposes only.
3. In-App Purchases
Any features or push notifications available through in-app purchases are processed solely through the Apple App Store or Google Play Store. We do not handle payments directly. Questions about billing or refunds should be directed to the respective store.
4. Maintenance and Support
We are solely responsible for providing any maintenance and support services for the App (if any), as described in this EULA or as required by law. You acknowledge that neither Apple nor Google has any obligation whatsoever to furnish any maintenance or support services with respect to the App.
5. No Warranty
The App is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied. We are solely responsible for any product warranties, to the extent they are not effectively disclaimed.
In the event the App fails to conform to any applicable warranty, you may notify Apple or Google, and the respective store will refund the purchase price for the App (if any) to you. To the maximum extent permitted by law, neither Apple nor Google will have any other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are our sole responsibility.
Important Safety Note: Tsunami alerts and information come from third-party sources and may have delays, inaccuracies, or failures. Our systems may also be subject to errors or system downtime, resulting in delayed or missed notifications. Do not rely solely on the App for life-saving decisions. Always follow official government alerts, local authorities, emergency services, and your own best judgment.
6. Product Claims and Intellectual Property
We, not Apple or Google, are responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including (but not limited to) product liability claims; claims that the App fails to conform to any legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, we (not Apple or Google) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Limitation of Liability
To the fullest extent permitted by applicable law, we and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you will not exceed the amount you paid for the App or in-app purchases in the 12 months before any claim (if any). This does not limit our liability in ways prohibited by applicable law.
8. Termination
We may terminate or suspend your license to use the App at any time, with or without notice, for any reason. Upon termination, you must stop using the App and delete it from your devices. Provisions that by their nature should survive (including ownership, disclaimers, and liability limits) will continue to apply.
9. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
10. Third Party Terms
When using the App, you must comply with any applicable third-party terms of agreement (for example, your wireless data service agreement or the terms of the Apple App Store or Google Play Store).
11. Privacy
Your use of the App is also governed by our Privacy Policy, available at https://tsunami.watch/privacy.
12. Governing Law
This EULA is governed by the laws of the State of Oregon, without regard to conflict of laws principles. Any disputes will be resolved exclusively in the state or federal courts located in Linn County, Oregon.

14. Third Party Beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof. Google is not a third-party beneficiary under this EULA.
15. General
This EULA is the entire agreement between you and us regarding the App. If any provision is held invalid, the remainder will continue in full force. We may assign this EULA; you may not. The App is not directed at children under 13.
